TERMS AND CONDITIONS
GENERAL TERMS AND CONDITIONS ELLAHAIR
ARTICLE 1 - DEFINITIONS
- EllaHair: Based in Barendrecht, Chamber of Commerce number 86004743.
- Customer: The person with whom EllaHair has entered into an agreement.
- Parties: EllaHair and the Customer together.
- Consumer: A Customer who is also an individual acting as a private person.
ARTICLE 2 - APPLICABILITY
- These terms apply to all offers, quotes, orders, agreements, and deliveries of services or products by or on behalf of EllaHair.
- Deviations from these terms can only be made if agreed upon in writing.
- EllaHair and the Customer explicitly exclude the applicability of any terms and conditions of the Customer or others.
- By placing an order, the Customer accepts these general terms.
ARTICLE 3 - PRICES
- EllaHair uses prices in euros, inclusive of VAT, and exclusive of additional costs such as administration or shipping fees, unless otherwise agreed in writing.
- EllaHair may change the prices of its services or products on its website or in other communications at any time.
- Increases in the cost price of products or their components, which EllaHair could not foresee at the time of making the offer or establishing the agreement, may lead to a price increase.
- The Consumer has the right to cancel an agreement due to a price increase unless the increase is due to a legal requirement.
ARTICLE 4 - PAYMENTS AND PAYMENT TERMS
- EllaHair may require a deposit of up to 50% of the agreed amount when entering into the agreement.
- The Customer must make the full payment upon or after delivery.
- The payment terms set by EllaHair are strict deadlines. This means that if the Customer does not pay the agreed amount by the last day of the payment term, they are automatically in default, without the need for a reminder from EllaHair.
- EllaHair may make delivery dependent on immediate payment or require security for the total amount of the services or products.
- All orders must be paid for in advance.
ARTICLE 5 - DELIVERY
- The products are delivered to the address provided by the Customer unless otherwise agreed.
- Although EllaHair tries to indicate delivery times as accurately as possible on the website and in the shipping and return policy, this information is only an estimate. Actual delivery time may vary due to factors such as product availability and shipping conditions.
- If delivery is delayed, the Customer will be informed as soon as possible. EllaHair is not required to provide any form of refund or compensation for delayed deliveries unless legally required.
- EllaHair is not liable for loss or damage to packages during shipping, except in cases of negligence on our part. In the event of loss or damage, EllaHair will work with the Customer to find a solution. Inspect the package upon receipt and report any damage immediately to Mibella Hair and PostNL.
- For international deliveries, additional costs such as shipping fees, taxes, or customs duties may arise. These costs are not included in the product price or the shipping fees paid at the time of the order. The Customer is responsible for these additional costs, which may be charged by local authorities upon delivery.
ARTICLE 6 - RIGHT OF WITHDRAWAL AND RETURN
- A Consumer may cancel an online purchase within 7 days without giving a reason. This right of withdrawal does not apply if:
- The product has been used.
- The product has been custom-made or adapted for the Consumer.
- The Consumer has waived their right of withdrawal.
- The withdrawal period begins the day after the Consumer receives the product.
- To exercise the right of withdrawal, the Consumer must send an email to Info.ellavarela@gmail.com.
- The Consumer must return the product within 7 days of notifying EllaHair of their withdrawal. Failure to do so voids the right of withdrawal.
- Returns are at the Consumer's own expense unless it is an error on our part.
- If the Customer returns a product at their own initiative, this is at their own risk. We are not responsible for lost or damaged returns outside of our proposed return process. Please use a shipping method that provides proof of shipment and tracking.
ARTICLE 7 - SHIPPING COST REFUNDS
- If a Consumer withdraws a purchase on time and returns the entire order to EllaHair, EllaHair will refund any shipping costs paid by the Consumer within 14 days after receiving the complete returned order.
ARTICLE 8 - WARRANTY
- The warranty does not apply if the defect is due to improper or inappropriate use, such as not following the care instructions correctly.
- If the Customer alters the products, such as dyeing or perming them, the warranty is void, and Mibella Hair will not handle complaints.
- EllaHair will respond within 14 days of receiving a complaint with a proposal for resolution.
ARTICLE 9 - LIMITATION OF LIABILITY FOR ALLERGIC REACTIONS
- EllaHair is not liable for allergic reactions or other adverse effects that may result from using the products.
- Customers are advised to check the ingredients list carefully and, if necessary, perform an allergy test before use.
TERMS AND CONDITIONS ELLA VARELA
TREATMENT CONDITIONS
The general terms and conditions of Ella Varela apply to every agreement, both oral and written, between the hairdresser and the Customer. The conditions cover the points described below.
PRICES
- The price list reflects the amounts for the hairstyles offered and can be found on the booking site and Ella Varela's social media channels. The price is divided into two parts: a deposit and the remaining balance.
- For questions about the price, the Customer can contact via all available channels. If no questions are asked, it is assumed that the prices are known and clear to the Customer.
DEPOSITS AND BALANCE
- To confirm an appointment, a deposit is required. The remaining balance must be paid in cash after the appointment.
- Deposits are non-refundable in the event of cancellations or rescheduling. For timely cancellations/rescheduling, the deposit will be applied to the next appointment.
CANCELLATIONS AND RESCHEDULING
- The Customer has up to 24 hours before the appointment to cancel or reschedule. If canceled or rescheduled within 24 hours of the appointment, 50% of the total amount will be charged.
- If the Customer fails to show up without notifying the hairdresser, no further appointments will be possible, and the full amount will be charged.
TIME
- The Customer must arrive on time. As a courtesy, the hairdresser allows an extra 15 minutes. After that, the appointment is automatically canceled, and 50% of the total amount is due.
HAIR CONDITION
- The Customer must arrive with clean hair, washed with shampoo. No oil, grease, or gel should be in the hair. If the hairdresser finds product residue in the hair, the appointment will be canceled, and the deposit will be forfeited.
LIABILITY
- The hairdresser assumes that the Customer is in good physical condition. Any special conditions, medical information, or allergies must be disclosed before treatment. If the Customer insists on proceeding against advice, the hairdresser is not liable for any consequences.
- Complaints must be filed within 48 hours after the treatment. The Customer must give the hairdresser a chance to resolve the issue with a new treatment.
VIP SPOT
- Booking a VIP spot is possible outside the hairdresser’s working hours, and VIP spots are automatically assigned during weekends and late hours. An additional €20 will be charged for VIP spots.
